The Suspension of Senator Natasha Akpoti-Uduaghan

The recent six-month suspension of Senator Natasha Akpoti-Uduaghan by the Nigerian Senate has raised significant concerns regarding potential conflicts of interest and adherence to principles of natural justice. This action followed her allegations of sexual harassment against Senate President Godswill Akpabio.
Central to this issue is the legal maxim “Nemo judex in causa sua,” meaning “No one can be a judge in their own case.” This principle underscores the necessity for impartiality in adjudicative processes. In this instance, Akpabio, as the Senate President, presided over proceedings that led to Akpoti-Uduaghan’s suspension, despite being the subject of her allegations. Critics argue that his involvement compromised the fairness of the process, as he did not recuse himself, thereby acting as a judge in his own cause.
Furthermore, procedural irregularities have been highlighted. Reports indicate that Akpoti-Uduaghan was found guilty of all allegations against her for failing to appear before the Senate Committee on Ethics, Privileges, and Public Petitions to defend her claims. This absence raises questions about the thoroughness and fairness of the investigation.
The suspension also has broader implications for democratic representation and gender equality. Akpoti-Uduaghan, one of the few female senators, represents Kogi Central. Her suspension disenfranchises her constituents for six months, effectively silencing their voice in legislative matters. This action could deter women from participating in politics, fearing unfair treatment and systemic biases.
In response, Akpoti-Uduaghan has denounced her suspension, stating, “This injustice will not be sustained.” She maintains that the suspension violates principles of natural justice, fairness, and equity, and asserts that it does not withdraw her legitimacy as a senator.
