Anyanwu’s interpretation of Appeal Court ruling sacking him is wrong, judgement is declaratory, cannot be stayed

By Barr Nwachukwu Joshua

The recent Appeal Court ruling sacking Senator Samuel Anyanwu as the National Secretary of the Peoples Democratic Party (PDP) has been deemed declaratory and cannot be stayed.

This means that Anyanwu’s removal from office is immediate and irreversible.

Contrary to Anyanwu’s claims, the Appeal Court’s judgement is clear and unequivocal.

The court affirmed the earlier judgement of the High Court in Enugu, which upheld the nomination of Rt Hon Sunday Ude-Okoye as the new National Secretary of the PDP.

The PDP has received the Certified True Copy (CTC) of the judgement and has confirmed that the ruling is declaratory in nature.

This means that the judgement is not subject to stay or appeal, and Anyanwu’s removal from office is final.

Therefore, staffers, all members and stakeholders of the party are advised to respect the rule of law and the judgement of the Appeal Court.

In the light of the above, Senator Samuel Anyanwu is also advised to accept the judgement and vacate the office of the National Secretary with immediate effect.
