Former LG chair Awogu, others threaten to drag Anambra Governor Soludo to court over non-conduct of LG election
By Alphonsus Nweze, Onitsha
A former chairman of Ogbaru Local Government Area of Anambra State, Comrade Arinzechukwu Awogu and two others, Chidi Okoye, and Dr. Charles Chukwudalu Ebulue, all former All Progressives Grand Alliance (APGA) chieftains but now All Progressives Congress (APC) members have threatened to drag Governor Chukwuma Soludo to Court if he fails to put machinery in motion within three months to conduct Local Election in the State.
set up the Anambra State Electoral Commission (ANSIEC).
In a letter to Governor Soludo by the trios written on their behalf by an Onitsha based legal practitioner and two time member of Anambra State House of Assembly, Hon. Chugbor Enwezor, they said after the expiration of 90 days and the Governor has not complied with their demands to set up the Anambra State Independent Electoral Commission (ANSIEC) they would have no option than to drag him to Anambra State High Court.
They expressed worry that the last Local Government election in the state was held during the twilight of Peter. Obi’s administration in 2014.
They lamented that it was so bad that successive Governors including Prof. Soludo who has been in the office for two years did not set up State Electoral body.
Awogu with his group argued that the Governor has a constitutional duty to conduct Local Government election in the state but it is not in existence, which has made it difficult the State to organize Local Government election.
” The Governor has a duty to set up ANSIEC by appointing the chairman and members. As a Governor who occupies office as a result of the constitution he has a duty to preserve the constitution in all its ramifications, including the existence of democratically elected Local Government” they said in the letter.
They continued : “Its boggles the mind that the product of the democratic exercise would seek to deny others the benefits of the same process. The above should not be the case with the Governor of a frontline State like Anambra”.
After the expiration of this pre-action notice in three months, they said, and there is no action from the Governor they threatened to drag him to the Anambra State High Court to seek for “an order of mandamus and other ancillary reliefs compelling you to perform the public duty imposed on you by Sect.198 of the 1999 constitution”.
