The Anambra State National/State Assembly Petition Tribunal has affirmed the election of Uchenna Okonkwo of Labour Party as the authentic winner of Idemili North/South Federal Constituency in the February 25, 2023 election.
Delivering Judgement, a member of the three-member Panel, dismissed the Petifion filed by Lateef Fagbemi now Attorney-General of the Federation on behalf of Ikenna Iyiegbu, Obi Cubana’s younger brother.
Iyiegbu had asked the Tribunal to sack Okonkwo on the ground that he was not a valid member of Labour Party among other issues.
But Okonkwo’s counsel, Ejike Ezenwa (SAN) in his reply countered that the petitioner bas no locus to question Labour Party who it fielded in the election going by relevant decided cases.
He also contended that the issues they raised were pre-election matters which the Tribunal has no jurisdiction to entertain .
Ezenwa equally raised the issue of witness because they stated that their witness was a male from Awka but the person who eventually appeared was a female.
And he told the Court that they don’t have witness which the Judge pointed out in his judgement.
Delivering the judgement on behalf of others on Wednesday at Awka, Justice A. T. Changbo agreed with Ezenwa and dismissed the petitioner’s case.
In his reaction, Olusola Dare from Fagbemi’s chambers praised the judgement, saying that the lordships agreed with some of their arguments but the conclusion was against them.
